			<content:encoded><![CDATA[<p><em><strong><span style="text-decoration: underline;">Legislators Reach New Budget Agreement undefined Governor Approves</span></strong></em></p>
<p><em>Budget writers reached a new agreement Thursday evening and the Governor has indicated he will support it. The new compromise avoids closing prisons but eliminates state agency middle management positions originally opposed by the Governor. Other cuts include a $13 million reduction to providers of in-home care to seniors and people with disabilities. Budget shortfalls were cushioned by a $56 million infusion of funds from Philip Morris and an $8.9 million settlement with Farmers&#8217; Insurance. Additionally, a portion of the settlement with mortgage lenders will be retained to offset future shortfalls. The budget proposal must be approved by both the House and the Senate.</em></p>

<p><em><strong><span style="text-decoration: underline;">Legislators Prepare for Adjournment</span></strong></em></p>
<p><em>The Oregon Senate will meet for a week-end Floor Session tomorrow morning (Saturday) at 9:30 a.m. in anticipation of wrapping up the 2012 Legislative Session next week. The Oregon House has recessed for the week-end and will return Monday. Earlier today on the Floor of the House, legislators remonstrated against failure to act on foreclosure relief and jobs bills. Some had anticipated that both the House and Senate would work through the week-end in an attempt to adjourn by the 26<sup>th</sup>. However, as of today, the original February 29 goal remains the most likely scenario. </em></p>

<p><em><strong><span style="text-decoration: underline;">OSCC Sponsors Chamber Day</span></strong></em></p>
<p><em>The Oregon State Chamber of Commerce, in partnership with Associated Oregon Industries, sponsored its 2012 Chamber Day as nearly 100 representatives of the business community met in</em></p>
<p><em>Salem</em><em> earlier today. Attendees received in depth issue updates on timber, water, health care, education, and the budget. Effective legislative advocacy and a briefing on the upcoming election cycle were also hot topics.</em></p>

<p><em><strong><span style="text-decoration: underline;">Senate Republicans Introduce Solution to PERS Shortfall</span></strong></em></p>
<p>Senate Republicans introduced a bill this week to save taxpayer dollars by curtailing spending for the Public Employee Retirement System. <strong><span style="text-decoration: underline;"><span style="color: #ff0000;"><a title="blocked::http://www.leg.state.or.us/12reg/measpdf/sb1500.dir/sb1593.intro.pdf" href="http://www.leg.state.or.us/12reg/measpdf/sb1500.dir/sb1593.intro.pdf"><span style="color: #ff0000; text-decoration: underline;" title="blocked::http://www.leg.state.or.us/12reg/measpdf/sb1500.dir/sb1593.intro.pdf">SB 1593</span></a></span></span></strong> would lower the assumed interest rate used to calculate annuity benefits from 8% to 6%. This is not the 8% assumed earnings rate guaranteed to Tier One retirees on their account contributions during employment, but the rate that PERS uses to calculate payouts for all Tier One and Tier Two employees once they retire, based on a lifetime annuity. Annuities in the private market are typically calculated using a much lower percentage assumption. Senate Republican Leader Ted Ferrioli (R-John Day) stated that if passed, the bill will save taxpayers and local governments billions of dollars.</p>
<p>“This is a solution that brings government benefits in to closer alignment with private sector benefits and begins to address a problem that has seemed unassailable,” said Senator Chris Telfer (R-Bend). “The longer the legislature lets this problem go unaddressed, the more it costs taxpayers.”</p>

			<content:encoded><![CDATA[<p><em><strong><span style="text-decoration: underline;">First Annual Session Convenes</span></strong></em></p>
<p>The first constitutionally authorized Annual Session convened on February 1. While other “short sessions” have been held in February, they were experimental in nature and not sanctioned by Oregon’s constitution.</p>
<p>As expected, the primary focus of the February Session is the projected $300 million budget shortfall. As many as 270 pieces of legislation have been introduced, although given the strict timeline legislative leadership has adopted, it will be an uphill battle to reach the Governor’s desk. That timeline is as follows:</p>
<p>Wednesday, February 1 Legislature Convenes</p>
<p>Monday, February 6 Deadline for bills to be posted for hearing in chamber of origin</p>
<p>Wednesday, February 8 Revenue Forecast</p>
<p>Tuesday, February 14 Last day for policy committees to hold work sessions on bills in their chamber of origin</p>
<p>Tuesday, February 21 Deadline for bills to be posted for hearing in second chamber</p>
<p>Thursday, February 23 Last day for committees to hold work session on bills in second chamber</p>
<p>Wednesday, February 29 Target Sine Die (Adjournment)</p>
<p>Although the target date for adjournment is February 29, the legislature actually has 35 days to conclude business. The legislature held “pre-session” hearings prior to convening in order clear the way for several key issues. Those bills that did not receive a pre-session hearing will be at the bottom of the heap for consideration.</p>
<p>&nbsp;</p>
<p><em><strong><span style="text-decoration: underline;">Business Legislation of Interest</span></strong></em></p>
<p><a title="blocked::http://www.leg.state.or.us/12reg/measpdf/hb4000.dir/hb4098.intro.pdf" href="http://www.leg.state.or.us/12reg/measpdf/hb4000.dir/hb4098.intro.pdf"><span style="color: #0000ff;" title="blocked::http://www.leg.state.or.us/12reg/measpdf/hb4000.dir/hb4098.intro.pdf">HB 4098</span></a> would increase annual timber harvests on state forestlands by setting a percentage (95%) of harvestable timber expected to be grown (measured in million board feet). Proponents say that the percentage could drop to 85% but the impact of that drop would be equal to approximately 3,200 jobs. The business community generally supports the proposal as a “jobs bill”; however, the Governor has indicated that he opposes the bill. Should the bill pass, it would apply to timber harvests and expected harvestable timber growth in calendar years beginning on or after January 1, 2013. HB 4098 is currently in the House Agriculture Committee.</p>
<p><a title="blocked::http://www.leg.state.or.us/12reg/measpdf/hb4100.dir/hb4101.intro.pdf" href="http://www.leg.state.or.us/12reg/measpdf/hb4100.dir/hb4101.intro.pdf"><span style="color: #0000ff;" title="blocked::http://www.leg.state.or.us/12reg/measpdf/hb4100.dir/hb4101.intro.pdf">HB 4101</span></a> directs the Water Resources Department to aggressively pursue development of the Columbia River Basin water resources. The bill would establish the Columbia River Task Force to make recommendations for new allocations of specified amounts of water from sources within the Columbia River Basin. The Water Resources Commission would be required to consider and take action on the task force’s recommendations. While the proposal would likely produce more jobs than HB 4098 mentioned above, it faces a number of obstacles, including opposition from tribes and conservation groups.</p>

<p><a title="blocked::http://www.leg.state.or.us/12reg/measpdf/hb4000.dir/hb4067.intro.pdf" href="http://www.leg.state.or.us/12reg/measpdf/hb4000.dir/hb4067.intro.pdf"><span style="color: #0000ff;" title="blocked::http://www.leg.state.or.us/12reg/measpdf/hb4000.dir/hb4067.intro.pdf">HB 4067</span></a> represents a very narrow fix for FaceBook with regard to concerns over its enterprise zone agreement. The problem is the sixty year old “Central Assessment” law, a policy adopted by a number of states, originally intended to apply to railroads, telephone companies, and electrical utilities. However, the Oregon Department of Revenue’s application of the policy currently treats FaceBook’s data center as a utility, resulting in the company potentially being taxed on both its tangible and intangible assets held worldwide. The company is located in Prineville and has an Enterprise Zone agreement with Crook County. Representatives of the company state that, had they known about the law in advance, they would not have located in Oregon. HB 4067 would exclude a company owning or leasing a data center in an enterprise zone from central assessment during the period of enterprise zone exemption.</p>
<p><a title="blocked::http://www.leg.state.or.us/12reg/measpdf/hb4000.dir/hb4076.intro.pdf" href="http://www.leg.state.or.us/12reg/measpdf/hb4000.dir/hb4076.intro.pdf"><span style="color: #0000ff;" title="blocked::http://www.leg.state.or.us/12reg/measpdf/hb4000.dir/hb4076.intro.pdf">HB 4076</span></a> is another attempt to address Oregon’s capital gains tax. The bill, championed by Rep. Matt Wand (R-Troutdale) would reduce the rate of personal income and corporate excise tax on capital gains, if gains are attributable to sale or exchange of investment made on or after January 1, 2012, and before January 1, 2014, and are held for at least three years.</p>
<p><a title="blocked::http://www.leg.state.or.us/12reg/measpdf/hb4100.dir/hb4164.intro.pdf" href="http://www.leg.state.or.us/12reg/measpdf/hb4100.dir/hb4164.intro.pdf"><span style="color: #0000ff;" title="blocked::http://www.leg.state.or.us/12reg/measpdf/hb4100.dir/hb4164.intro.pdf">HB 4164</span></a> implements the Health Exchange passed via SB 99 during the 2011 legislative session. Both the House and Senate Health Committees held informational meetings during the interim to receive updates on implementation, thus paving the way for a fast track through the February Session. However, as with many well intended concepts, the devil is in the details. Discussions such as the one that occurred in the House Health Committee on February 1 regarding whether employees of the Exchange should have access to their own health coverage rather than be covered under the Public Employees’ Benefit Board (PEBB), may prove controversial enough to slow the bill’s progress.</p>

<span><em>Tax Court Rejects Arguments of Oregon Department of Revenue</em></p>
<p>In a key court decision that flew under the radar during the Christmas holiday, the Oregon Tax Court sided with Con-Way, Inc. in its dispute with the Oregon Department of Revenue.</p>
<p>At issue: Con-Way&#8217;s use of Oregon&#8217;s Business Energy Tax Credit (BETC) to offset its corporate minimum tax liability under Measure 67.</p>
<p>For the 2009 tax year, Con-Way acquired a BETC credit of $75,000. Con-Way reported no net income for 2009, but generated enough sales to trigger a $75,000 corporate minimum tax liability under Measure 67. Con-Way applied its BETC credit to offset its 2009 tax liability.</p>
<p>The Oregon Department of Revenue disallowed Con-Way&#8217;s use of the BETC credit and instead assessed penalties and interest, asserting that the Measure 67 corporate minimum tax law requires a cash payment each year in the amount of any liability calculated under the Measure 67 scheme regardless of any tax credits.</p>
<p>The Tax Court disagreed. It admonished the Department, saying, <em>&#8220;…the department asks the court to add words to the statute so that it reads that there is an obligation to pay &#8216;in cash and without regard to any tax credit otherwise available to the taxpayer.&#8217; Not only does the statute not contain those words, the context of the revenue laws as a whole indicates that when the legislature desires to prevent a tax credit from being used to satisfy a minimum tax obligation, it knows how to say so and has, in fact, said so.&#8221;</em></p>
<p>In short the Court found no legislative evidence supporting the Department&#8217;s position.</p>
<p>The effect of the ruling to AOI members is that BETC credits may now be applied against corporate minimum tax liabilities.</p>
<p><span style="text-decoration: underline;">Might the Legislature try and intervene?</span> The interim legislative Revenue Committees discussed this issue last September. Representative Phil Barnhart (D-Eugene) argued that he and his Democratic colleagues meant to deny offsetting when they passed the tax increases in the 2009 Legislative session. Representative Vicki Berger (R-Salem) countered that she wasn&#8217;t in the group of legislators that passed Measure 67 and she didn&#8217;t see the words in the statute. The Tax Court affirmed her position.</p>
<p>AOI will keep a close watch on this issue during the February 2012 Legislative session. It is likely that a 3/5 supermajority vote of the legislature would be needed to deny Oregon companies the ability to offset corporate minimum tax liabilities with the BETC credit.</span></p>
<p><a name="Fuel"></a><span style="color: chocolate;"><strong>Oregon&#8217;s Low Carbon Fuel Conundrum</strong></span><br />
<span><em>Gasoline or diesel, a gallon may be getting pricier</em></p>
<p>Following a wave of California greenhouse gas measures (including AB32, cap and trade, <em>etc.</em>) the 2009 Oregon Legislature adopted a statute allowing the Oregon Department of Environmental Quality (DEQ) to adopt rules implementing a low carbon fuel standard (LCFS) similar to one currently pending in the Golden State.</p>
<p>Generally speaking, a LCFS mandates the reformulation of conventional transportation fuels – gasoline and diesel – to reduce their carbon content, and establishes quotas requiring the use of alternative fuels such as bio-diesel and cellulosic ethanol.</p>
<p>The primary concern regarding a LCFS is that it will trigger an economic chain reaction driving consumer fuel costs higher and resulting in supply disruptions. This could occur for two reasons; the LCFS relies on various fuels that have not yet been invented or perfected, and are not available in sufficient quantities to meet the mandated usage. These fuels are typically more expensive than their conventional counterparts, a factor likely to be compounded as scarce supplies drive consumer prices even higher. In addition, the required changes in gasoline and diesel formulations will add to fuel producers&#8217; costs while simultaneously limiting the amount of fuels that can be sold in the state. Higher production costs and reduced availability force upward pressure on prices at the pump. Higher fuel prices translate to higher costs for goods and services leading to job losses as businesses adjust their budgets to accommodate increased costs and consumers have less disposable income. In short, the economic impact could be felt across all sectors</p>
<p>Two weeks ago a federal court blocked enforcement of the California low carbon standard, citing, amongst other things, that it over-reaches its scope of regulatory authority and circumvents lawmaking activity that is appropriately the province of the federal government, not individual states.</p>
<p>Even before the recent court decision, red flags were being raised not only by California&#8217;s fuel producers and business community, but the state&#8217;s Energy Commission who warned that the LCFS could cost fuel providers billions of dollars, costs which could go even higher if other states adopt a similar standard. It also raised concerns about the availability of corn-oil biodiesel, the supply of renewable diesel and the feasibility of using half the U.S. supply of cellulosic fuels in 2018 and beyond – and that&#8217;s just to meet California&#8217;s quotas.</p>
<p>How the California case affects Oregon&#8217;s nascent program is not yet clear. The statute does not demand, simply allows, the agency to promulgate such rules. But it is rare that the legislature passes a measure granting an agency authority to implement a major new program without expecting them to carry it out.</p>
<p>To its credit, the DEQ has approached the issue with care. Although it put together a workgroup and produced a report, it has not yet proposed formal rules. The agency has been watching the developments in California and discussing the issues with various stakeholders.</p>
<p>Likewise, Washington State&#8217;s program is also on hold pending the outcome of the California case, which the California Air Resources Board is appealing.</p>
<p>Once that appeal is resolved the DEQ will need to make a decision as to whether or not to move forward with a program.</p>
<p>Complicating (or simplifying, depending on one&#8217;s point of view) the issue is the fact that the Oregon statute enabling the DEQ program contains a sunset provision that, if not removed by a vote of the legislature, will sunset authority for the program in 2015. Consequently, absent such a bill, any DEQ fuel program will be defunct almost upon startup.</p>
<p>It should be interesting.</span></p>
<p><a name="Ed"></a><span style="color: chocolate;"><strong>Community Members Invited to Discuss Education, From Pre-kindergarten Through College and Career Readiness</strong></span><br />
<span><em>Meetings slated for seven Oregon cities January 17 to 30</em></p>
<p>The Oregon Education Investment Board will hold seven community meetings across the state later this month, to discuss next steps to improve student success in Oregon&#8217;s public education system, from pre-kindergarten through to college and career readiness.</p>
<p>Thousands of individuals have already participated in surveys, offered ideas in public testimony and met with representatives of the Governor&#8217;s Office around the state. Now local students, educators, parents and community members are invited to the meetings to share their ideas to support student learning.</p>
<p>Each of the seven meetings will run from 6:30 to 8:30 p.m. After a brief presentation on the Oregon Education Investment Board&#8217;s proposals, most of the time is reserved for participants to discuss and share their thoughts.</p>

<p>The Oregon Education Investment Board is proposing legislative action in February 2012 to streamline early childhood programs and create a system of accountability for student success from pre-kindergarten through K-12 to college and career readiness. 			<content:encoded><![CDATA[<p>This week the Oregon Prosperity Project was honored by our colleagues across the country.  We received the STAR Award for Best Prosperity Project Communications of 2011.  We are honored and humbled by the recognition. And we hope its further evidence that we’re making a difference. We never want to lose sight of our goal of making Oregon the most prosperous state in the nation.</p>
<p>To us, this means growth in career and job opportunities here in Oregon. We believe we can accomplish a goal of adding 25,000 new private sector jobs in Oregon per year.  We also believe that an improved economy will raise incomes and standards of living for our friends and neighbors across the state. Oregon incomes lag the national average by 10%. We believe we can grow Oregon incomes to exceed the national average in less than 10 years.</p>
<p>But all of this requires a concerted effort to be educated and make policy choices and choices on election day that will put Oregon on this path. We want to be on the leading edge of informing you about these choices.  Today we say “thank you” for the recognition and continued thanks for your support.</p>

<p>Regulatory issues are often cited as extremely problematic at virtually every level in Oregon, making expansion or job creation difficult and slow. However, the state of the economy, as well as renewed interest in regulatory reform, has, in the eyes of many, made this the most opportune time in decades to make real progress.</p>
<p>The effort involves an Advisory Group and a Working Group. The high-level Advisory Group intends to have an &#8220;Initial Proposal&#8221; drafted and ready to go by the end of this year and a &#8220;Final Proposal&#8221; sent to the Governor by mid-2012. The Initial Proposal will serve a scoping document, and the Final Document, more of a map intended to suggest both short-term immediately implemental changes, as well as longer-term systemic reforms. <li>Collect a sampling of &#8220;real world&#8221; cases that highlight the inefficiencies or problems with the current system so that the strategic roadmap we develop addresses the real world problems;</li>
<li>Conduct benchmarking studies and a survey of &#8220;best practices;&#8221;</li>
<li>Identify the &#8220;game changing&#8221; process improvement projects underway in Oregon;</li>
<li>Monitor the ongoing &#8220;Dredge/Fill&#8221; permit process improvement project so that we can identify how we can use the lessons learned from that project in future projects;</li>
<li>Develop a detailed, multi-year, strategic roadmap that sets forth how the state should go about achieving lasting, meaningful improvements to the processes and enhance the outcomes we seek to achieve.</li>

<p>Since 2002 the Oregon Business Plan has provided the framework for Oregon&#8217;s business, elected, and community leaders to work together on ideas, policies, and concrete actions to strengthen Oregon&#8217;s economy. The Oregon Leadership Summit is the place where Business Plan initiatives are presented and discussed for adoption in new state policy and legislation.</p>
<p>This year, state budget reform is central to the summit agenda. A struggling economy shrinks revenues available for public services and threatens disinvestment in education vital to Oregon’s economic future. <strong>We must budget better to do more with less</strong>.</p>
<p>Join us December 12 at the Oregon Convention Center to learn more about the fiscal reforms embraced by the Governor and Legislature this past year. There will also be special follow-up summit work sessions the next day, December 13, at the Convention Center to focus more closely on implementing key reforms in education, health care, and other state services that will help Oregon do more with less during these fiscally challenging times.</p>
